Terms of Service

1. Booking & Payment Terms

  • A booking is considered confirmed only upon receipt of a signed service agreement and a non-refundable deposit of 25% of the total fee.
  • The remaining balance is due no later than the day of the event, prior to the start of service, unless otherwise agreed in writing.
  • Accepted payment methods include credit card, debit card, bank transfer, or cash. A completed Credit Card Authorization Form is required for all card transactions.

2. Event Access & Client Responsibilities

  • The Client must ensure clear, legal, and safe access to the event location for Yum Yum Ice Cream vehicles or carts.
  • Required parking accommodations, permits (for public spaces or venues), and any gate or property access codes must be provided at least 48 hours prior to the event.
  • If the Provider is unable to access the event site due to insufficient access, lack of clearance, or improper communication, no refund will be issued.

3. Weather Policy & Rescheduling

  • Events may proceed in light rain or heat unless conditions are deemed unsafe by Yum Yum Ice Cream.
  • In case of severe weather, the Client may reschedule the event once, subject to availability, provided a minimum of 24 hours’ notice is given.
  • No refunds will be issued due to cancellations caused by inclement weather. Rescheduling is a one-time courtesy.

4. Menu Items & Product Availability

  • All menu items are subject to availability. While we make every effort to deliver your selected items, substitutions of equal or greater value may be made without prior notice due to stock or supplier limitations.
  • Final menu selections and quantities must be confirmed at least 72 hours prior to the event.

5. Guest Count & Service Minimums

  • The Client must provide an accurate estimated guest count. If the actual attendance exceeds this number, Yum Yum Ice Cream reserves the right to charge for additional servings.
  • Service packages are designed for a specific number of servings. Requests for unlimited or open service require custom pricing.

6. Allergies, Dietary Needs & Liability

  • Yum Yum Ice Cream cannot guarantee an allergen-free environment. Products may contain or come into contact with dairy, nuts, soy, gluten, and other allergens.
  • The Client is responsible for informing guests of potential allergens and assumes liability for any allergic reactions unless due to Provider’s gross negligence.

7. Damage, Delays, & Interference

  • The Client is financially responsible for any damage to Yum Yum Ice Cream equipment, vehicles, or property caused by guests or third parties during the event.
  • If delays are caused by Client or venue (e.g., late access, event not ready), Yum Yum may adjust or shorten service time accordingly without refund.
  • Aggressive, inappropriate, or unsafe behavior directed at staff will result in immediate termination of service without refund.

8. Cancellations & Refunds

  • Cancellations made more than 7 days prior to the event are eligible for a refund of any balance paid, excluding the deposit.
  • Cancellations within 7 days are non-refundable, but Yum Yum may allow rescheduling at its discretion.
  • “No show” by the Client or failure to provide accurate event information results in full forfeiture of all fees.

9. Photo & Video Use

  • Yum Yum Ice Cream reserves the right to photograph or record its setups and service experience during events for promotional use, unless otherwise requested in writing.
  • If minors are present, Client agrees to obtain any necessary photo permissions.

10. Indemnification

  • The Client agrees to indemnify and hold harmless Yum Yum Ice Cream, its staff, affiliates, and partners from any claims, damages, or liabilities resulting from the event, except in cases of gross negligence or willful misconduct.

11. Force Majeure

  • Yum Yum Ice Cream is not liable for any delay or failure in performance due to events beyond its control, including but not limited to acts of God, weather, government restrictions, labor strikes, power failures, or pandemic-related restrictions.
